Reasons Why you lost your Social Security Disability Case
There are many reasons a Claimant loses his/her Social Security Disability case. I have compiled a few main reasons I see people lose their case.
1.Lack of medical treatment:
This is generally the number one reason people are denied Social Security disability benefits. The Social Security disability program requires medical proof that you suffer a severe condition that affects your ability to work. If you have not sought treatment from a doctor for your condition there is no evidence that you really suffer from this condition, other than your word. And frankly, Social Security will not rely on your word when determining eligibility. To often a Claimant will talk about their mental health problems, but they have no mental health treatment or they get some medicine from their family doctor. This does not help your case. If you can not afford to goto the doctor, find a free clinic or a clinic that has a sliding scale for paying.
2. You are able to work:
The second reason Claimant's are denied benefits is when they do suffer a medical condition that affects their ability to do the work they have done in the past, it does not limit them from performing their past work or other work in the national economy. The Social Security program is a 5 step process. Steps 4 and 5 looks at whether you are able to perform your past work in spite of your limitations and whether there are other jobs in the national economy which you could perform with your current physical and mental limitations.
3. Lack of knowledge about the Social Security program:
The third major reason Claimant's are denied Social Security Disability benefits is they do not understand the program. The Social Security Disability program may seem pretty simple, but I promise you it is not. It is very complex with a number of rules and regulations that go into making a decision. Applying for benefits without seeking help from an experienced attorney is not a good idea. You should find an attorney before you start your case. Often times Claimant's start their own case and try to find an attorney once they lose their original application. This is a mistake.
4. You have lost your case before:
Many people will lose their Social Security Disability case and right away file a new case. Unless there is a change in your medical impairments or you have changed age groups it is not recommend to file a new case right away. If a person files a new case right after losing, Social Security is bound by the prior decision. I tell clients to wait atleast 6 months to file a new case. I tell them to treat with new doctors and try new treatment. You can not just keep filing the same case over and over.
